Frequently Asked Questions
What is the Executive Office for Immigration Review?

The Executive Office for Immigration Review (EOIR) is a federal agency under the control of the U.S. Department of Justice and is tasked with overseeing the immigration court system. The EOIR comprises Immigration courts, the Board of Immigration Appeals (BIA), and the Office of the Chief Administrative Hearing Officer. This court system is where decisions are made as to whether or not a non-citizen should be charged with violating immigration law and whether individuals should be permitted to remain in the U.S. or be deported back to their home country. In addition, acting under the authority of the Attorney General, the EOIR conducts immigration legal proceedings.

What is naturalization?

Naturalization is the term that describes the process a foreign national must go through to become a lawful permanent resident (LPR). However, before an individual can obtain U.S. citizenship, they must go through a lengthy process and meet all requirements outlined in the Immigration and Nationality Act (INA). Because the immigration process can be very demanding to attempt on your own, it is always best to obtain assistance from a highly trained immigration lawyer. In addition, an immigration lawyer can help you so that you do not inadvertently do something that may impede your ability to obtain citizenship.

What should I do if I have received a notice to appear (NTA) from Immigration and Customs Enforcement (ICE)?

If you have received a notice to appear from ICE, you must attend all the scheduled court hearings. If you do not comply with the notice, you risk deportation. You should also verify that all of the information on the NTA is correct, including your date of birth, address, and alien registration number. If any of the information needs to be corrected, you will need to file a Form EOIR-33/IC as soon as possible to avoid the chance of not receiving further notice. Finally, if you do not have an immigration lawyer, you must obtain legal counsel as quickly as possible to protect your rights.

What is premium processing?

Premium processing is a service the USCIS provides, which applicants can utilize to shorten the processing time of visas and green cards. The service is optional, but it could significantly shorten the wait time to 15 calendar days. However, only certain visas are eligible under premium processing. Some of the most common include H-1B and H-2B workers, EB-1, 2, and 3 workers. In addition, it should be noted that premium processing is not an option for J-1, EB-1C, or EB-2 workers that qualify for a National Interest Waiver. Because it can be confusing to understand which visas may qualify for premium processing, it is always best to consult with an experienced immigration attorney.

What is a green card?

A green card, also called a permanent resident card, allows a non-citizen to live permanently in the United States. The green card also proves that the individual may be legally employed and travel freely within the country. Most individuals who immigrate to the U.S. want a green card because it affords them the same freedoms as any other citizen. However, the process involved in obtaining a green card can be costly and time-consuming. For this reason, if you or a family member want to obtain a green card, you must speak with an attorney familiar with immigration law.

What relatives can a U.S. citizen sponsor?

If you are a legal U.S. citizen, you can sponsor eligible relatives. Eligible relatives include your spouse and children, regardless of age or marital status. In addition, if you are at least 21 years or older, you may also act as a sponsor for a sibling or a parent. However, the immigration process can be daunting to try and handle on your own. Therefore, if you would like to sponsor a relative, it is always advisable to consult with an immigration law attorney who can provide you with more information.

What is a fiancé visa?

A fiancé visa is also called a K-1 nonimmigrant visa. A K-1 visa is used by a foreign-born fiancé who intends to marry a United States citizen. This visa allows individuals to travel to the United States to marry their U.S. citizen sponsor. However, one stipulation of the K-1 visa is that the couple must be married within 90 days of the fiancé’s arrival. As with any visa, a significant amount of paperwork must be filled out and turned in quickly to speed up the processing time. Additionally, other stipulations must be followed to qualify for a K-1 visa.

What is family-based immigration?

U.S. citizens who wish to bring family members to this country utilize family preference immigrant visas. In some instances, individuals who are lawful permanent residents may also utilize family preference visas. Some relatives who fall under this category include married children, siblings, or cousins. However, the federal government places strict limits on how many individuals may enter the U.S. through family-based immigration. However, a knowledgeable immigration lawyer can explain the law more thoroughly and determine if your family relationship meets the eligibility requirements.
