Deferred Action for Childhood Arrivals (DACA or sometimes called DREAM act) under fire

Not even 2 weeks since the deferred action (DACA) forms are released, and Obama administration is being sued by ICE agents.  With the current political atmosphere, it is not surprising that a bold move such as DACA or Deferred Action for Childhood arrivals, which grants 2 year renewable work permits to eligible youth who entered the US prior to age 16 and graduated high school or are currently in high school or a GED program, got some heat. What is surprising is that it is moving quickly and being challenged in court.

Led by Kris Kobach, the infamous author of the Arizona bill, ICE agents are claiming that this new provision punishes them for following the US federal law and forces them to violate the law and their vows to uphold it. Already Immigration Impact and other pro-immigrant news are rebutting the grounds. But for immigrants this move raises a lot of questions.

What will happen if the Obama administration loses even in part? What if Mitt Romney wins in November? Although Mitt Romney has remained silent on the issue of deferred action, Kris Kobach has previously advised him on immigration issues. What should applicants do to protect themselves?
